LubeCalc Pro App Terms of Service

Please read these Terms of Service ("Terms") carefully before using the LubeCalc Pro mobile application (the "App") operated by Spartan Lube Oil Systems LLC ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of the App

LubeCalc Pro is a professional engineering calculator application designed for rotating equipment and fluid power engineers. The App provides calculation tools for lube oil systems, hydraulics, seals, heat exchangers, pressure vessels, pump selection, motor sizing, pipe sizing, pneumatics, and related engineering domains.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal or professional use.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App

  • Reverse engineer or attempt to extract the source code of the App

  • Use the App for any unlawful purpose

  • Remove or alter any proprietary notices or labels on the App

3. Purchases and Payment

LubeCalc Pro is available as a one-time purchase at $49.99 (USD) with a 3-day free trial. Payment is processed through the Apple App Store or Google Play Store, subject to their respective terms and conditions.

  • Free Trial: New users receive a 3-day free trial of all premium features. You will not be charged during the trial period.

  • One-Time Purchase: After the trial period, a one-time payment of $49.99 unlocks permanent access to all premium features.

  • Refunds: Refund requests are handled by the Apple App Store or Google Play Store in accordance with their refund policies. We do not process payments or refunds directly.

4. Professional Use Disclaimer

IMPORTANT: LubeCalc Pro is an engineering reference and calculation tool. It is NOT a substitute for professional engineering judgment.

  • All calculations, results, and reference data provided by the App are for informational and reference purposes only

  • Users are solely responsible for verifying all calculations and results before applying them to any engineering project, design, or decision

  • The App's calculations are based on published engineering standards and methodologies, but no guarantee is made regarding the accuracy, completeness, or applicability of any result to your specific situation

  • Always consult with a qualified licensed professional engineer before making engineering decisions based on any calculation tool

  • The App does not replace the need for proper engineering analysis, review, and professional oversight

5. Intellectual Property

The App, including all content, features, functionality, design, code, graphics, and documentation, is owned by Spartan Lube Oil Systems LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

Engineering formulas and methodologies implemented in the App are based on publicly available standards and references. The specific implementation, user interface, and presentation are proprietary to Spartan Lube Oil Systems LLC.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free

  • The results obtained from the App will be accurate or reliable

  • Any errors in the App will be corrected

  • The App will meet your specific requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPARTAN LUBE OIL SYSTEMS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or business opportunities

  • Personal injury or property damage

  • Engineering errors, design failures, or equipment damage resulting from reliance on the App's calculations

  • Any damages arising from your use of or inability to use the App

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.

8. Indemnification

You agree to indemnify, defend, and hold harmless Spartan Lube Oil Systems LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your violation of these Terms.

9. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.

11. Third-Party Services

The App uses RevenueCat for purchase validation and the Apple App Store or Google Play Store for payment processing. Your use of these third-party services is subject to their respective terms of service and privacy policies.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Spartan Lube Oil Systems LLC regarding your use of the App and supersede any prior agreements.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Michigan.
